Notice of Preliminary Hearing on Petition for Ditch Improvement

Otter Tail County Ditch 70

Pursuant to Minnesota Statutes 103E.212, and other applicable statutes, a petition was filed with the Otter Tail County Board of Commissioners, Drainage Authority, to improve Ditch 70. The project involves ­­­­­­­­­­­­­­­­­­­­­­a new outlet from Sewell Lake along a new alignment with a larger tile.
Altering the course of the ditch and increasing tile size. A benefited area for the proposed drainage project is expected to be the entire system.

The following is a list of lands which may be affected by these proceedings:
  • St Olaf Township (T131N, R41W): All or parts of sections 9,10, 11, 14, 15, 16, 17, 20, 21, 22 23, 26, 27, 28, and 29.
The estimated project costs are $350,000, which includes construction (excavation, tiling and culverts), right-of-way acquisition, utility relocations, engineering, legal expenses, contingencies, and other miscellaneous and administrative costs. The project would be financed through local assessments to benefited properties as determined by Viewers. Benefited property will be determined following the preliminary hearing, if the County Board orders the project development to continue.

The County Board has scheduled the preliminary hearing on the Petition, in accordance with M.S.A.103E.261, for the 28th day of April, 2014, at 7:00 p.m. at the Otter Tail County Government Services Center, 500 West Fir Avenue, Fergus Falls, Minnesota.

The purpose of the hearing is to determine if the petition is sufficient, to review the Minnesota Department of Natural Resources and Minnesota Board of Water and Soil Resources advisory reports, and to review the preliminary survey report as prepared by Houston Engineering, Inc. Following the hearing, the County Board, can either dismiss the petition, or make an order to continue the proceedings, including directing the engineer to prepare the Detailed Survey Report, appointment of Viewers, and scheduling of the final hearing. A copy of the Engineer's Preliminary Survey Report is on file in the office of the County Auditor, 500 W. Fir Ave. Fergus Falls, Minnesota, and is available for public inspection during regular business hours, it is also posted on the county website, www.co.ottertail.mn.us.

All persons interested in this matter are required to appear before the Otter Tail County Drainage Authority, at this hearing to show cause, if any you may have, why said Petition for a drainage system improvement should not be continued and such other and further proceedings held in accordance with the law provided.
